Moroccan Wife Legally Recognized as Heir in Kuwaiti Inheritance Case

In a significant ruling by the Family Court in Kuwait, a Moroccan woman was officially recognized as an heir of her late Kuwaiti husband, following a legal amendment to his inheritance certificate. This decision came after the woman, whose marriage to the deceased was legally established, filed a lawsuit when she discovered her name was omitted from the inheritance documentation. Despite holding a marriage certificate issued by the Sharia Documentation Department under the Ministry of Justice and a prior court ruling confirming their marital status, the initial inheritance certificate did not acknowledge her as a rightful heir.

The court, after reviewing the evidence provided, concluded that the documents substantiated her claim as the deceased’s wife, thereby entitling her to inheritance rights under both Sharia and Kuwaiti law. Consequently, the court ordered an amendment to the inheritance certificate to include her name, and mandated that the defendants cover all court-related expenses and attorney fees.

Jarrah Al-Malik, the woman's attorney, emphasized the importance of this ruling, stating that it reaffirms the necessity of protecting a wife's Sharia and legal rights once the marriage is established, alongside the associated legal obligations. This case not only highlights the individual's rights within the family law framework in Kuwait but also serves as a precedent for similar cases in the future, ensuring that marital relationships are legally recognized and protected.
