Fez Faces Property Disputes Amid Significant Financial Judgments

Fez Confronts Major Challenges in Property Management

The city of Fez, Morocco, finds itself once again facing significant challenges in managing disputes related to real estate and illegal encroachments on private properties. This comes in light of recent final rulings issued by the Administrative Court in the city, mandating substantial financial compensation for affected parties in cases involving the use of properties without completing the necessary legal procedures. Local sources have confirmed that these recent appellate judgments involve cases with considerable financial implications. Notably, one ruling requires the municipality of Fez to pay more than 971,000 dirhams, while another case involves compensation exceeding 15.43 million dirhams, and a third property-related case has a compensation limit set at approximately 4.45 million dirhams.

These amounts highlight the burdens that local budgets may bear when real estate issues are not resolved according to legal protocols. The challenges extend beyond the issuance of financial judgments, raising critical questions about how to secure the necessary land for public infrastructure and services, as well as the adherence to legal procedures for consensual acquisitions or expropriation for public benefit. Moreover, it is essential to ensure the legal status of properties before initiating any construction work.

Legal Rulings Extend to Educational Institutions

In a related context, the administrative court in Fez has also ruled that the regional academy for education and training in the Fez-Meknes region must pay approximately 3.98 million dirhams. This ruling stems from the establishment of an educational institution on private land without completing the expropriation process and compensation according to legal standards. This particular case underscores that the issue is not limited to local municipalities but also extends to public institutions that are expected to set an example in adhering to legal frameworks.

The situation emphasizes the necessity to review the mechanisms for managing real estate disputes within public institutions, enhance coordination between technical and legal departments, and implement pre-emptive audits of the available land before launching projects. Additionally, it highlights the importance of proactive settlement of disputes rather than allowing them to escalate into court rulings that drain funds that could otherwise be allocated to infrastructure and services.

Ultimately, the primary responsibility lies with the councils and institutions concerned to ensure the implementation of final judicial rulings while drawing lessons from previous cases. This will help prevent the establishment of public facilities from becoming a source of new disputes or additional financial obligations that burden the city’s budget.
