Moroccan Administrative Court Declares Nullity of Motorcycle Federation Assembly

Significant Legal Ruling on Moroccan Motorcycle Federation

The Administrative Court of Appeals in Marrakech recently confirmed the nullity of the minutes from the assembly meeting of the Moroccan Royal Motorcycle Federation, which took place on June 6, 2024. This ruling, issued on October 20, 2026, reaffirms a previous decision by the Administrative Court of Marrakech that identified significant procedural breaches during the assembly, prompting several members of the federation's board to challenge the legality of the meeting through legal channels.

The legal representatives, led by attorney Rashid Abourk from the Casablanca Bar Association, presented various grievances to the court, detailing alleged irregularities that accompanied the assembly's proceedings. The initial ruling declared the assembly minutes invalid, a decision that has now been upheld by the appellate court, making it a landmark case for the federation.

Attorney Abourk elaborated that this judicial verdict highlights ongoing issues within the Moroccan Royal Motorcycle Federation, issues that he claims originated from the assembly whose minutes have now been invalidated. He pointed out that these problems primarily stem from the exclusion of board members from decision-making processes, the marginalization of clubs, and the concentration of power in a single entity. Furthermore, he noted violations of Law No. 30.09 regarding physical education, sports, and the federation's statutes, as well as other regulations governing its operations.

Abourk characterized the current state of the Moroccan Royal Motorcycle Federation as catastrophic, attributing this to the expiration of its president's term in April 2025, thus holding him accountable for the institution's deteriorating condition. He emphasized that this ruling is critically important, as it raises questions about the future of decisions made following the invalidated assembly, particularly concerning the management of funds spent without board oversight and the financial governance of local and international sporting events.

Moreover, the attorney argued that the ruling declaring the assembly invalid brings into question the legality of all subsequent meetings held and the minutes recorded thereafter, which he believes should also be deemed null and void by law. He concluded by mentioning that there are ongoing legal proceedings concerning various documents and the use of meeting minutes, in addition to other lawsuits related to the federation's financial matters, with board members awaiting further judicial decisions.

Abourk stressed that since April 15, 2026, the Moroccan Royal Motorcycle Federation has been in a state of vacancy and stagnation, highlighting the urgent need for intervention by the relevant ministry to restore order and ensure the resumption of normal operations and activities within the federation.
